Important Tax Legislation on Used Machinery Depreciation
The President signed HR 5297 into law on September 27, 2010 and this could have a positive impact on your business.
HR-5297 is aimed at helping small business, and among other provisions it raises Section 179 expensing levels to $500,000 (and the phase-out threshold amount to $2 million) for 2010 and 2011. Section 179 can be utilized to expense the cost of Used Machinery.
The new law raises the limit from the previous level of $250,000 for small businesses. The $500,000 amount applies to the cost of depreciable tangible personal property purchased for use in the active conduct of a trade or business for taxable years beginning in 2010. This $500,000 amount is reduced, however, by the amount by which the cost of the qualifying property placed in service during 2010 exceeds $2,000,000. Note that the deduction amount continues to be limited to the taxpayer's taxable income derived from the active conduct of the trade or business. Any amount that exceeds the taxable income limitation may be carried forward to succeeding taxable years.
